These Terms of Use (“Terms”) govern your use of the Still Here iOS application (“the App”) and the website at https://getstillhere.app (together, “the Service”). By using the Service, you agree to these Terms.

By downloading, installing, or using Still Here, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

3. Description of the Service

Still Here is a privacy-first iOS application designed for couples after conflict. The Service provides the following features:

• Private check-ins — log your feelings, needs, and intensity privately.
• Reflections and private notes — write freely without pressure.
• Tone Check — optional, on-device analysis of draft messages (deterministic/local Tone Check fallback is used where available; full Tone Check using advanced on-device AI may be a Plus feature).
• Soft signals — choose a pre-written message to send to your partner when words feel too hard.
• Partner thread — a shared space for signals and replies that you explicitly choose to send.
• Pattern insights — Plus feature providing private, deterministic analysis of your check-in history.

The App is designed for personal, non-commercial use within a romantic partnership.

4. Not Therapy, Crisis Support, or Professional Advice

Still Here is not a therapy app, a relationship coaching service, a diagnosis tool, an abuse-detection system, a mental-health treatment app, or a crisis support service.

Still Here is a private communication utility for couples. It does not diagnose, treat, prevent, or cure any mental health condition. It does not provide medical, psychological, legal, or professional advice. If you are in crisis, experiencing abuse, or need immediate support, please contact a qualified professional or emergency service in your region.

Tone Check provides gentle, rule-based or on-device AI feedback on your word choice. It does not evaluate your relationship, your partner, or the merits of a conflict. It does not determine who is right or wrong.

5. Eligibility

You must be at least 13 years of age to use Still Here. If you are under 18, you must have parental or guardian consent to use the Service.

6. User Accounts, iCloud, and Partner Pairing

Still Here does not require a traditional account with a username and password. The App uses your Apple ID and iCloud account for:

• Syncing your private data across your own devices via your private iCloud container.
• Pairing with a partner through CloudKit Sharing (CKShare).

Pairing exchanges only a CKShare acceptance and an optional display name. No Apple ID, phone number, email address, or contact data is shared with your partner. You may unpair at any time, which revokes the shared CKShare and clears the shared store locally.

7. Subscriptions and Purchases

Still Here offers an optional auto-renewing subscription (“Still Here Plus”) through the Apple App Store. The following terms apply:

• Products: Still Here Plus is available as a yearly subscription (Product ID: com.ries.stillhere.plus.yearly,€19.99/year, with a 7-day free trial where offered) or a monthly subscription (Product ID: com.ries.stillhere.plus.monthly,€2.99/month). Prices are displayed in the App Store purchase sheet, which controls the final displayed terms.
• Payment: All payments are processed by Apple through your App Store account. We do not collect or store payment information.
• Auto-renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. This can be managed in your App Store account settings.
• Free trials: Any free trial period is offered at Apple’s discretion and according to the terms displayed in the App Store purchase sheet. Unused portions of a free trial are forfeited upon purchasing a subscription.
• Pricing changes: Prices may change. You will be notified before any price change takes effect.
• Refunds: All refund requests are handled by Apple in accordance with Apple’s refund policies. Please contact Apple Support for refund-related inquiries.
• Cancellation: You can cancel your subscription at any time through your App Store account settings. The subscription will remain active until the end of the current billing period.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Use the Service to generate, store, or share harmful, abusive, or inappropriate content.
• Interfere with the operation of the Service or bypass any technical measures.
• Use the Service to monitor, harass, pressure, track, or surveil a partner. Still Here is a tool for voluntary, mutual connection. It is never to be used as a surveillance or monitoring tool.

9. Intellectual Property

Still Here, including its name, logo, design, code, and content (excluding user-generated content), is the property of Jonathan Ries / Ries A&AI and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission.

10. User Content and Partner-Visible Content

You retain ownership of the content you create using Still Here, including check-in logs, private notes, reflections, and signals. By using the Service, you grant us a limited license to process this content solely for the purpose of providing the Service to you. We do not claim ownership of your content.

Your partner sees only the soft signals, replies, intent labels, and scheduled talk times that you explicitly choose to send. Check-in logs, private notes, reflections, Tone Check data, unsent drafts, and pattern insights are never shared with your partner.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information. By using the Service, you consent to the practices described in that policy.

12. Third-Party Services

The App may use third-party services (such as Apple’s on-device frameworks, iCloud, CloudKit, StoreKit, website hosting providers, and external font services such as Google Fonts). Your use of these services is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of these third parties.

13. AI-Assisted and Deterministic Features Disclaimer

Tone Check and Pattern Insights are provided for informational and personal reflection purposes only. They do not constitute professional advice, therapy, counseling, or diagnosis. AI-assisted Tone Check results are generated by Apple Foundation Models running entirely on your device and may not always be accurate or appropriate. The deterministic Tone Check engine applies rule-based analysis and may not capture nuance. You should always use your own judgment when communicating with your partner.

14. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Jonathan Ries / Ries A&AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This limitation applies even if we have been advised of the possibility of such damages.

16. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or if required by law. Upon termination, your right to use the Service immediately ceases. You may stop using the Service at any time by deleting the App from your devices.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory consumer protection provisions of your country of residence. If you have no country of residence in the European Union, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Stuttgart, Germany.
